SEATING

To ensure fairness for all passengers, seating selection is on a first-come, first-serve basis and specific seats (other than for those requiring special assistance) may not be reserved in advance. Passengers may not reserve or hold seats for individuals boarding at a different location. It is recommended that companions board the same bus at the same departure point to ensure seating and traveling together. The Flutter Express may assign seats in certain cases for safety or operational reasons. If one individual requires two seats, an additional charge will be incurred.  Please email travel@theflutterexpress.com or call 518-217-5121 with any questions. 

 

SMOKING

In accordance with the law and in the interest of the health and comfort of our passengers, smoking aboard the motor coach bus (56-passenger), The Flutter Bus, The Flutter Shuttles, or any vehicles operated, chartered or contracted by The Flutter Express is strictly prohibited. 

 

ALCOHOLIC BEVERAGES

Absolutely NO alcoholic beverages are permitted on the bus or any Flutter Express transportation service. Any person found with alcoholic beverages onboard is subject to immediate removal—NO EXCEPTIONS and NO REFUNDS.

 

BAGGAGE

Each passenger is permitted one large piece of luggage for storage in the compartment on the bus. A small overnight bag is also allowed, if carried by the passenger and stored in an overhead compartment on the bus. We will make every effort to handle baggage and personal belongings with care.

When traveling via 7-8 passenger van, luggage space is limited. Passengers may bring one standard bag and one small personal bag, subject to available space. 

When traveling via the 24-36 passenger bus and 12-15 passenger sprinter van: Passengers may bring one standard bag and one small personal bag, subject to available space. Passengers are advised to consider vehicle capacity when packing. The Flutter Express does not assume liability for loss or damage to property.

 

CHANGE OF DEPARTURE

In the event you must change your boarding location (chosen at the time of reservation), please notify our office as soon as possible, preferably no later than one (1) week prior to your date of departure. Departure points CANNOT be changed on the day of departure.

 

ADJUSTMENTS TO ROUND-TRIP DESTINATION PICK-UP/DROP-OFF LOCATIONS

Due to traffic conditions and other factors in New York City and Boston, we may need to adjust pick-up or drop-off locations. We are committed to ensuring the best service possible and appreciate your understanding and flexibility as we navigate these dynamic conditions.


Passengers traveling in smaller vehicles such as 24-36 passenger bus, 7-8 passenger vans, or 12-15 passenger sprinter vans, may experience minor schedule or route adjustments due to vehicle capacity, traffic, or logistical constraints. The Flutter Express is not liable for resulting variations in pickup or drop-off times.

TIMELINESS AND ITINERARY COMPLIANCE

Passengers must arrive at designated pickup locations at least ten (10) to fifteen (15) minutes prior to scheduled departure. The Flutter Express is not liable for missed rides or delays in arrival or departure resulting from passenger tardiness, inclement weather, road closures, traffic conditions, or other events beyond its reasonable control. Schedules are subject to change without notice, and The Flutter Express shall not be liable for consequential damages arising therefrom.

TYPE OF VEHICLE

The Flutter Express is a transportation service that connects customers to their destinations with 56-passenger motor coach buses (MCI J4500) provided by Yankee Trails. The 56-passenger motor coach bus is not a medical bus or an ambulatory transportation vehicle.


In some cases, The Flutter Express may provide transportation using The Flutter Bus, a 24-36 passenger bus with a driver, or one of our Flutter Shuttles, a 7-8-passenger vehicle with a driver or sprinter van (up to 12-15 passengers) with driver instead of the 56-passenger motor coach provided by Yankee Trails or another professional motor coach company. Each vehicle provides standard transportation services and is not a medical or ambulatory transport vehicle. All liability limitations and service policies apply equally to every type of vehicle.

PARKING

Parking at all locations is at your own risk and the responsibility of the traveler. The Flutter Express, its vehicle partners, and each departure location, does not indemnify or assume liability for any lost or damaged personal property.

VEHICLE SUBSTITUTION CLAUSE
The Flutter Express reserves the right to substitute any vehicle for another based on availability, maintenance, or operational needs, provided passengers receive equivalent transportation service.

RESPONSIBILITIES

The Flutter Express reserves the right to withdraw any service or make any changes to any service, including substituting vehicles, changes of itinerary, or transportation, with or without notice. Passengers accept that smaller vehicles such as 24-36 passenger, 7-8 passenger van or 12-15 passenger sprinter van may have limited seating, storage, or accessibility compared to motor coaches (56-passengers).

  • Motor Coaches (56-passenger): These vehicles are owned and operated by Yankee Trails or another motor coach service company. The Flutter Express charters these buses solely as a transportation service provider and does not have operational control over the motor coaches or their personnel. Consequently, The Flutter Express cannot be held liable for personal injury, property damage, delays, accidents, or other loss arising from the use of these motor coaches.

  • Buses 24-36 passenger, 7-8-passenger vans and sprinter vans 12-15 passengers: These vehicles are owned by Flutter Club, inc. and operated by The Flutter Express. While The Flutter Express maintains operational control of these vehicles during travel, passengers acknowledge that transportation in smaller vehicles may involve limited seating, storage, or accessibility.

General Liability Disclaimer: Regardless of vehicle type, The Flutter Express does not assume responsibility for and cannot be held liable for personal injury, property damage, or other loss arising from travel, including but not limited to vehicle issues, weather-related delays, traffic incidents, or acts of God. Carrier responsibility and liability to any patrons is limited to the transportation services provided.

Insurance Recommendation: Travelers are strongly encouraged to obtain accident, medical, and baggage insurance.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, The Flutter Express, its owners, employees, agents, contractors, affiliates, and volunteers shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to personal injury, death, loss of property, or financial loss arising from or in connection with the use of its services, whether based in contract, tort, strict liability, or otherwise. Passengers expressly waive any and all claims against The Flutter Express arising out of or relating to transportation services provided.


These limitations apply to travel on both the motor coach buses Flutter Express charters, 24-36 passenger buses,12-15 passenger sprinter vans and seven+ (7-8) passenger vans.

HEALTH AND SAFETY

Passengers are solely responsible for managing their personal medical needs, medications, and any required medical equipment during travel. The Flutter Express does not provide medical services or assistance and shall not be held liable for any health-related events, injuries, or medical emergencies occurring during the course of transportation. Passengers with complex or high-risk medical conditions

MASK POLICY

To ensure the health and safety of all passengers, masks are encouraged but not required.

We kindly ask that any customers experiencing symptoms such as fever, cough, sore throat, runny nose, diarrhea, or vomiting refrain from traveling until they are symptom-free and fully recovered.

If anyone develops or shows symptoms as described above during the trip, they may be asked to wear a mask to help ensure the safety and comfort of others.

Please note that masks may be required in situations where there are widespread health concerns in the community, such as contagious outbreaks or viruses with a high spread rate, to protect the health of all passengers.

Your cooperation is greatly appreciated as we work together to maintain a safe and comfortable environment for all passengers.

GROUP TRAVEL

If you are securing reservations for passengers other than yourself, YOU are responsible for informing them of ALL Flutter Express (The Flutter Express) policies. When traveling with passengers who have booked separately, please notify our office at the time your reservation is made. 

 

GOOD TRAVELERS CODE

Travel necessitates being good-natured, having a sense of humor, and requires an agreeable acceptance of situations as they occur, not as we might prefer them to be. A tolerance for changes will make your experience enjoyable for you and fellow travelers. 

PASSENGER CONDUCT AND COMPLIANCE

All passengers are expected to conduct themselves in a lawful, respectful, and orderly manner at all times while utilizing The Flutter Express services. The Flutter Express reserves the right, in its sole discretion, to refuse transport to any individual whose conduct is deemed disorderly, disruptive, unsafe, or in violation of applicable laws or these Terms and Conditions.


Passengers traveling via 7-8 passenger vans or 12-15 passenger sprinter vans should be mindful of the smaller seating and shared space, and maintain respectful behavior for all passengers.

TRAVELING WITH A CHILD EIGHT YEARS OF AGE OF YOUNGER

In compliance with Department of Transportation (DOT) regulations, all passengers must be accounted for on the vehicle, regardless of whether they occupy a seat.

  • On motor coaches and 36-passenger buses, children under the age of 2 may travel on the lap of an accompanying adult. However, a reservation is still required for every passenger, including infants.

  • In all other vehicles—including passenger cars, 7–8 passenger vans, and 15-passenger sprinter vansNew York State law requires that all children under the age of 8 travel in an appropriate child restraint system, as follows:

    • Under 2 years old: Must ride in a rear-facing car seat.

    • Ages 2–4: Must ride in a car seat with a harness (rear- or forward-facing, depending on size and manufacturer guidelines).

    • Ages 4–8: Must ride in a booster seat used with both a lap and shoulder belt.

  • It is the responsibility of the accompanying adult to provide and properly install the appropriate child restraint system when required.

Failure to comply with these regulations may result in denial of boarding.

UNACCOMPANIED MINOR & AGE OF TRAVEL

For the safety and well-being of all passengers, The Flutter Express has the following policy regarding unaccompanied travelers:


• Passengers must be at least 18 years old OR older to travel alone on The Flutter Express.
• Minors under 18 years of age must be accompanied by a parent, legal guardian, or responsible adult throughout the entire duration of the trip.
• The Flutter Express does not permit unaccompanied minors to travel on any of its services, regardless of maturity or prior travel experience.
• All children under the age of 14 will receive a Kid’s Flutter Kit and all travelers under the age of 18 years old must remain under adult supervision during the ride.

This policy is in place to ensure the safety, comfort, and appropriate care of all passengers—especially during unexpected delays or emergencies.

PERSONAL PROPERTY

Passengers are solely responsible for the care and security of their personal belongings at all times. The Flutter Express shall not be liable for any lost, stolen, or damaged items, whether occurring during transit, while boarding or disembarking, or after passengers have exited the vehicle. Any items left on the bus following departure are left entirely at the passenger’s own risk.


If lost property is located, it may be returned at the sole discretion of The Flutter Express, only upon proper identification and request. The Flutter Express will retain found items for a period of seven (7) calendar days from the date of discovery. After this holding period, unclaimed items may be discarded or donated, at the discretion of The Flutter Express. Perishable, hazardous, or unsanitary items may be disposed of immediately.

MOTORCOACH ROUND-TRIP SERVICE CANCELLATIONS AND REFUNDS

Customer Cancellations:
Passengers will be GUARANTEED a FULL REFUND when cancelling MORE THAN TWO (2) DAYS (48-hours) prior to departure, regardless of your reason. Please note that the ticket processing fee will be deducted from the refund amount.
For example:
o If your trip departs on Tuesday, you must cancel by Sunday.
o If your trip departs on Thursday, you must cancel by Tuesday.
Cancellations made within TWO (2) DAYS before departure are NOT ELIGIBLE FOR A REFUND.


The Flutter Express Cancellations:

The Flutter Express does not have a minimum passenger requirement.

We require a minimum of 15 passengers to operate the motor coach bus. If the 15-passenger minimum is not met, passengers will travel in The Flutter Shuttle (a 7-passenger van or 12-15 passenger sprinter van with a driver), which operates as our standard service and includes:

  • Roundtrip transportation

  • Bottled water each way

  • Snacks

  • Flutter Kits

If unforeseen circumstances prevent us from providing our transportation service, all riders will be notified and receive a full refund to their original payment method.

DISABILITIES AND ASSISTANCE

Customers with Disabilities:

The Flutter Express is committed to providing safe and convenient travel for our customers with disabilities.  It is illegal to discriminate on the basis of a disability.  We will provide assistance boarding and de-boarding buses as well as baggage handling at the beginning, during any rest stops (if requested), and at your destination.

Guidelines for our Wheelchair Lift Equipped Vehicles:

1. Please contact our office at 518-217-5121 or use our Contact Us Form at least 48 hours prior to your trip to provide us with information about your specific assistance needs.  This notice will help us minimize any delays or interruptions in your trip.  If less than 48 hours notice is given, we will still make every reasonable effort to accommodate your needs, but availability is not guaranteed and trip delays may result.

2. When using one of Yankee Trail’s wheelchair lift equipped buses, the combined weight of the customer and wheelchair cannot exceed 800 pounds.  The wheelchair cannot be more than 

- 326 and 328 wheelchair is 33.5” long and 30” wide

- 242 and 244 wheelchair is 48” long and 31.5” wide

Priority Seating for Customers with Disabilities:

Priority Seating refers to reserved seating, starting from the front of the bus and working toward the rear, for all our passengers with disabilities.  To minimize disruption of other passengers, please call our office at 518-217-5121 at least 48 (business) hours in advance of your departure so that we may have the driver/escort mark your seat accordingly.  If you do not call in advance, and the Priority Seating rows are occupied when you board the coach, the driver may ask the seated customer(s) to move.  If customer refuses to move, you may sit in the next available seat closest to this area of the coach.

Notice to Customers:

In accordance with federal regulations we do not require proof of disability.

Upon request to The Flutter Express personnel 48 hours or more in advance of travel, assistance will be provided to you for reasonable requests. We are committed to protecting your rights. If you would like to speak to someone about your needs or rights as a customer of The Flutter Express, please call us at 518-217-5121 or use our Contact Us Form.  If you feel that your rights as a person with a disability under the Americans with Disabilities Act (ADA) were violated and would like to file a formal complaint, please send a written statement.  Please include as much information as possible about your travel itinerary, and a detailed description of the incident, including: the bus number (if known), date, time and location, as well as the names(s) and/or description(s) of any Flutter Express personnel you believe did not provide you appropriate assistance.

Privacy:

Our phone operators, agents, and employees will use the information you provide related to your travel needs and schedule to arrange assistance by company personnel or contractors at your point of departure and your final destination. Other transportation carriers involved in your trip may receive this information as well to ensure your needs are met.

PHOTO AND VIDEO DISCLAIMER

The Flutter Express and Flutter Club, inc., reserves the right to use any photograph/video taken while traveling with The Flutter Express, without the expressed written permission of those included within the photograph/video.  This includes photos/videos taken by a Flutter Express staff member and/or photos/videos taken by a Flutter Express passenger.  The Flutter Express may use the photos/videos in publications or other media material produced, used or contracted by The Flutter Express, including but not limited to: flyers, catalogs, newspaper/magazine ads, television, websites, etc.
 
To ensure the privacy of individuals and children, images will not be identified using full names or personal identifying information without written approval from the photographed subject, parent or legal guardian.
 
A person traveling with The Flutter Express who does not wish to have their image recorded for distribution should make their wishes known to the photographer, driver and/or program director, and/or contact The Flutter Express at 10 Greenwood Drive, East Greenbush, NY 12061, in writing of his/her intentions and include a photograph for identification purposes only.  Such photo will not be distributed.  
 
By traveling with The Flutter Express and by failing to notify The Flutter Express, in writing, your desire to not have your photograph used by The Flutter Express, you are agreeing to release, defend, hold harmless and indemnify The Flutter Express from any and all claims involving the use of your picture or likeness.
 
Any person or organization not affiliated with The Flutter Express may not use, copy, alter or modify The Flutter Express photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorized designee from The Flutter Express.



ASSUMPTION OF RISK
By booking and accepting transportation services provided by The Flutter Express, all passengers expressly acknowledge and accept that travel by motor coach involves inherent risks. By traveling, passengers voluntarily assume all such risks and agree to release and hold harmless The Flutter Express from any and all claims, damages, or liabilities arising therefrom.
